Indiana Bill of Sale

Selling or buying a vehicle in Indiana? Here is what Indiana BMV says about the paperwork, and a free generator to make a signed bill of sale in minutes.

Quick answer

Bill of sale in Indiana: Not for titled vehicles. For a titled vehicle in Indiana, the title is the ownership document. The BMV says a bill of sale cannot transfer ownership of a vehicle that requires a title.

What Indiana requires for a vehicle sale

  • The BMV says a bill of sale cannot be used to transfer ownership of a vehicle that requires a certificate of title by law. It is accepted only in limited cases.
  • The BMV bill of sale is State Form 44237 or a similar document. A bill of sale application also needs State Form 39530 (Physical Inspection).
  • A bill of sale must show purchaser name, year, make, model, seller signature and seller address. The VIN is required if it is the primary ownership document.
  • The bill of sale does not need to be notarized or signed under penalties for perjury.
  • On the title, all owners sign and print names in the seller section, fill in the odometer statement, sale date, price and buyer details.
  • The buyer must apply for title within 45 days of purchase. Late applications incur a penalty, and sales tax is paid at the branch.

Indiana bill of sale: what to include

Whatever Indiana requires, a signed bill of sale protects both sides. It proves the price, the date and that the car was sold as-is. Include:

  • Seller's and buyer's full names and addresses
  • Year, make, model, color and VIN
  • Odometer reading on the day of sale
  • Sale price and date of sale
  • As-is wording, plus a statement that the seller owns the vehicle and any lien is paid off
  • Signatures and dates for both parties

Sample as-is wording

I, the seller, sell the vehicle described above to the buyer for the price shown, as-is, with no warranty, express or implied. The seller confirms they are the owner and that the odometer reading is correct to the best of their knowledge. This sale is made under the laws of Indiana.

Seller checklist (Indiana)

  • All owners sign and print their names in the seller section of the title.
  • Complete the odometer statement, date of sale, purchase price and purchaser information.
  • Remove the license plate at the time of the sale.
  • Keep a record of the sale for yourself.

Buyer checklist (Indiana)

  • Check that the seller and purchaser sections of the title are fully completed.
  • Apply for title within 45 days of purchase.
  • Pay sales tax on the purchase price at the branch when applying.
  • Get title, registration and plate in your name; an out-of-state vehicle needs a VIN inspection.

Things to watch in Indiana

  • The pages we read do not set a deadline for the seller or a release-of-liability step. Check with the BMV.
  • The odometer rules are not described on the pages we read beyond the title section.
