Utah Eviction Notice for Unpaid Rent
What Utah says a landlord must do before filing for eviction over unpaid rent, taken from official sources, with a free notice generator.
Quick answer
Utah: 3 business days to pay or vacate. Utah requires a written notice giving the tenant three business days after service to pay the rent or move out before the landlord files for eviction.
What Utah law says
- Utah Code 78B-6-802(1)(c): written notice requiring in the alternative payment of rent and other amounts due, or surrender of the premises, within three business days after service.
- The court page says the day of service is day zero and counting starts the next day, skipping weekends and court holidays.
- Service: hand it to the tenant, send by signature-required registered or certified mail, leave it with a responsible adult and mail a copy, or post it on the front door if no one is home.
- With several tenants, serve one copy for each person.
- The notice cannot be followed by court papers until it has expired.
Steps for a landlord
- Prepare the Three Day Notice to Pay or Vacate (form 1001EV).
- Serve it by a listed method and keep a copy.
- Count three business days starting the day after service.
- File court papers only after the notice has expired.
What to put in the notice
- The names of the tenants and the address of the rental
- The amount of rent owed and the rental period it covers
- The number of days the tenant has to pay or move out, and the date that period ends
- The date, how the notice was delivered, and who delivered it
- Your name and contact details, with your signature
Things to watch
- The statute version we read is dated 2020 and shows as superseded in 2026; confirm the current text.
- The court page does not list every required content item; the form sets them out.
- Cities and counties can add their own rules, including rent control and extra notice requirements. Check your local rules too.
About this page
We checked this page against the official sources listed below in November 2026. Where an official page did not say something, we say so. Laws change and courts read them differently, so confirm the current rule with the statute, the court or a local attorney before you act. This is general information, not legal advice.
