Oklahoma Eviction Notice for Unpaid Rent
What Oklahoma says a landlord must do before filing for eviction over unpaid rent, taken from official sources, with a free notice generator.
Quick answer
Oklahoma: 5 days written notice to pay rent. A landlord may terminate for unpaid rent if the tenant does not pay within five days after written notice of the demand for payment. The demand for past due rent also counts as a demand for possession.
What Oklahoma law says
- 41 O.S. 131(B): a landlord may terminate a rental agreement if the tenant fails to pay rent within five (5) days after written notice of the landlord's demand for payment.
- Demand for past due rent is deemed a demand for possession of the premises under 41 O.S. 131.
- 41 O.S. 111(E): written notices under the Act must be served personally unless otherwise specified by law.
- If the notice is posted, a copy must also be mailed to the tenant by certified mail (or through the Firm Mailing Book for Accountable Mail), per 41 O.S. 111.
Steps for a landlord
- Put the demand for rent in writing.
- State that the tenant has five days to pay the past due rent.
- Serve the notice personally, or post it and mail a copy by certified mail.
- Keep a copy and proof of service in case you file for eviction.
What to put in the notice
- The names of the tenants and the address of the rental
- The amount of rent owed and the rental period it covers
- The number of days the tenant has to pay or move out, and the date that period ends
- The date, how the notice was delivered, and who delivered it
- Your name and contact details, with your signature
Things to watch
- The pages we read do not say what the notice must contain beyond a written demand for payment.
- Older sections (41 O.S. 6 and 7) also mention 10-day and 5-day notices to quit; check the statute or a local attorney for which applies.
- Cities and counties can add their own rules, including rent control and extra notice requirements. Check your local rules too.
About this page
We checked this page against the official sources listed below in November 2026. Where an official page did not say something, we say so. Laws change and courts read them differently, so confirm the current rule with the statute, the court or a local attorney before you act. This is general information, not legal advice.
