Georgia Eviction Notice for Unpaid Rent
What Georgia says a landlord must do before filing for eviction over unpaid rent, taken from official sources, with a free notice generator.
Quick answer
Georgia: 3 business days to pay or vacate. Before filing a dispossessory for unpaid rent, a landlord must give written notice to vacate or pay all past due amounts within three business days.
What Georgia law says
- O.C.G.A. 44-7-50(c): the notice is a 'notice to vacate or pay all past due rent, late fees, utilities, and other charges owed to the landlord' within 'three business days'.
- Under 44-7-50(d), the notice 'shall be posted in a sealed envelope conspicuously on the door of the property' and delivered by any additional method agreed in the rental agreement.
- The state landlord-tenant handbook says the notice must be at least three business days before the landlord files, and that a demand must be in writing when the reason is unpaid rent.
- The handbook says the notice can be served by any method in the lease or by posting in a sealed envelope on the door.
Steps for a landlord
- Put the demand in writing with the amount past due.
- Give three business days to pay or vacate.
- Post it in a sealed envelope on the door and use any lease-agreed method too.
- File the dispossessory only after the deadline passes.
What to put in the notice
- The names of the tenants and the address of the rental
- The amount of rent owed and the rental period it covers
- The number of days the tenant has to pay or move out, and the date that period ends
- The date, how the notice was delivered, and who delivered it
- Your name and contact details, with your signature
Things to watch
- The pages we read do not say how holidays are counted; check the statute or an attorney.
- The pages do not list further required contents of the notice.
- Cities and counties can add their own rules, including rent control and extra notice requirements. Check your local rules too.
