Delaware Late Rent Fee Rules

What Delaware law says

• The state summary says a late charge may not be imposed until five days after the due date (25 Del. C. 5501, 5502(a)).
• The Code says a late charge in the rental agreement 'shall not exceed 5 percent of the monthly rent' (25 Del. C. 5501(d)).
• The summary says a late charge is treated as additional rent.
• If the landlord has no office or permanent place to receive payments in the county, the due date is extended by three days.

Steps for a landlord

• Put the late charge in the written rental agreement.
• Cap it at 5 percent of monthly rent.
• Wait until the fifth day after the due date.
• Extend the due date three days if you have no local payment location.

What to put in the notice

• The lease clause that allows the late fee
• The rent due date and any grace period
• The late fee amount and the total now owed
• How and where the tenant can pay
• The date and your signature
